When you delete content or close an account, we will delete or de-identify associated data within a reasonable period, subject to backup retention and legal obligations.

These Terms of Service (“Terms”) govern your access to and use of FormSafely. By creating an account or using the Service, you agree to these Terms.

FormSafely provides online tools to design, publish, share, and manage workplace-safety and related forms. Features may evolve over time as we improve the product. We may modify, suspend, or discontinue parts of the Service with reasonable notice when practicable.

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You must provide accurate registration information and notify us promptly of unauthorized use. If you use FormSafely on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMSAFELY AND ITS SUPPLIERS PROVIDE THE SERVICE “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FormSafely is a software tool; it does not replace professional safety, legal, or compliance advice.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMSAFELY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF YOU HAVE NOT PAID, ONE HUNDRED U.S. DOLLARS).

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes will be resolved in courts located in the United States, unless applicable law requires otherwise.
